Nonprovisional Utility Patent Applications

The most common type of patent application is the nonprovisional utility patent application. A nonprovisional utility patent application has rigid requirements which, if not satisfied in the initial application, may cause the patent applicant to lose substantial rights in the idea. Guided Self-Help

For those do-it-yourselfers, who want to do most of the legwork, we also provide a self-help option. We will: provide counsel, review and revise your application, and help you submit your provisional patent application. Design Patent Applications

The difference between what may be best protected by a design patent versus a utility patent is sometimes a fine line. Let us help you make an informed decision. If we decide that your product is suitable for design patent protection, we can prepare and file your design patent application.

Patent Prosecution

Submission of a patent application is only the beginning of a process that can take several years until a patent is granted. During pendency of your patent application, an examiner at the US Patent and Trademark office conducts a search for any previous publication of your idea. The vast majority of patent applications receive at least one rejection, called an "Office Action," from the examiner.

We are experienced at formulating arguments and amendments to overcome examiners' rejections while maintaining the integrity of your patent claims. If you received an Office Action, do not delay! Please give us a call to discuss your patent application. Most--but not all--Office Actions allow three months to respond (this timeframe can be extended by an additional three months in most cases). After discussing your application, we will provide a flat-fee quote of the total cost to prepare and file the office action response.

While not strictly necessary, conducting a patent search is recommended prior to filing a nonprovisional application, as the search results help guide us in anticipating potential rejections and crafting the patent claims accordingly.
